India’s insolvency regulator tightened the real estate resolution framework on 30 Oct 2026, adding project-wise financial controls and stronger homebuyer safeguards 🏠. The Insolvency and Bankruptcy Board of India notified the Fifth Amendment Regulations, 2026, following recommendations made in April by the Jayanti Prasad-led committee.
Key Points:
• Separate bank accounts must be maintained for each real estate project of a corporate debtor undergoing insolvency proceedings. Resolution professionals must also submit project-wise statements of receipts and payments to the Committee of Creditors at intervals decided by the committee.
• Creditors holding at least 66% of the voting share can recommend excluding an individual project from a corporate insolvency process, provided they record their reasons. The resolution professional must then apply to the adjudicating authority, which will decide on the request.
• Each project must undergo an independent construction assessment, while resolution plans must include scheduled delivery timelines and greater disclosure of project finances. The changes give homebuyers a larger role in a process intended to improve transparency, accountability and project completion ⚖️.
The amendments matter for real estate developers because project-level monitoring can separate viable developments from other assets or liabilities within an insolvent company. Separate accounts and regular financial statements also make it easier for lenders, homebuyers and the CoC to track whether project receipts are being used for the relevant development. The framework increases the importance of independently verified construction progress and credible delivery schedules across the sector
OI Charts data showed mixed positioning among listed real estate developers on 30 Oct. DLF closed at ₹691.55, down 0.4%, while futures open interest rose 0.6%, indicating a short build-up. Its ₹700 call had the largest call open interest, its ₹670 put had the largest put open interest, and max pain was ₹670 for the 23 Nov expiry. Godrej Properties fell 2% to ₹1,568, with futures open interest up 1.3% in a short build-up; its largest call and put open interest were both at ₹1,600. Oberoi Realty rose 0.4% to ₹1,646 as futures open interest declined 1.4%, indicating short covering.
The next focus is implementation by resolution professionals, creditor voting, project-wise financial reporting and adjudicating-authority decisions on project exclusion. Market participants will also track whether developers provide clearer construction assessments and delivery schedules under the amended framework.
